Who we are and what this notice covers
Oceanus Capital Management, LLC (“Oceanus”, “we”, “us”) operates this website, including its Chinese-language editions. This notice explains what personal information we collect from visitors to the site and from people who contact us through it, how we use it, and the choices you have.
It does not cover the personal information we collect from clients, fund investors, and prospective investors in the course of providing advisory services or processing a subscription. That information is governed by the separate privacy notice we deliver as a registered investment adviser, which is available on request from clients@oceanus-cap.com. Websites we link to are governed by their own notices.
Information we collect
Information you give us. The site has no accounts, forms, comment features, or newsletter sign-up. If you e-mail us, we receive your e-mail address, your name if you include it, the contents of your message, and any information you choose to provide about your eligibility when you request fund materials.
Information collected automatically. Like most websites, our web server keeps logs. Each request records the IP address it came from, the date and time, the page or file requested, the page that referred you, and the browser and operating system you used. We use these logs to operate and secure the site and to diagnose problems. We do not use them to build profiles of visitors.
What we do not collect. We do not use analytics services, advertising networks, social-media plug-ins, tracking pixels, or fingerprinting. The only cookie this site sets is a preference cookie that remembers you have seen the cookie notice (see the Cookie Notice below). We do not use browser storage.
How we use personal information
- to operate, secure, and improve the site, including detecting and preventing abuse;
- to respond to your inquiries and correspondence;
- to verify eligibility before providing fund performance, terms, or offering materials, which we make available only to verified eligible investors;
- to comply with legal and regulatory obligations, including the recordkeeping rules that apply to investment advisers;
- to establish, exercise, or defend legal claims.
Where the law requires a legal basis for processing (for example, for individuals in the European Economic Area or the United Kingdom), we rely on our legitimate interests in operating and securing the site and responding to you; on steps taken at your request before entering into an agreement; on compliance with legal obligations; and, where required, on your consent.
How we share personal information
We do not sell personal information, and we do not share it for advertising. We disclose it only:
- to service providers that host and operate the site and our e-mail, who process it on our behalf and under confidentiality obligations;
- to our professional advisers, including legal counsel, auditors, and compliance consultants;
- to regulators, courts, and law-enforcement or other authorities where required by law, regulation, legal process, or to protect the rights, property, or safety of Oceanus, our investors, or others;
- in connection with a reorganization, merger, sale, or similar transaction involving Oceanus, subject to appropriate confidentiality protections.
Retention
Server logs are rotated routinely and kept for a limited period, unless a longer period is needed to investigate a security incident. Correspondence is kept for as long as necessary for the purpose it was collected for and, where it forms part of our books and records as an investment adviser, for the period those rules require, which is generally at least five years.
Security
We use reasonable technical and organizational measures designed to protect personal information against unauthorized access, loss, or misuse. No method of transmission over the internet is fully secure. Please do not send account numbers, identification documents, or other sensitive information by unencrypted e-mail; we will never ask you to do so, and we will never ask you to transfer funds by e-mail.
Visitors outside the United States
This site is operated from, and its servers are located in, the United States. If you visit from elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those of your country. Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal information, to object to processing, to withdraw consent, and to lodge a complaint with a supervisory authority. To exercise them, contact clients@oceanus-cap.com.
California residents
To the extent the California Consumer Privacy Act applies to Oceanus, California residents have the right to know what personal information we collect and how we use and disclose it (this notice is that disclosure), to request access to or deletion of it, to correct inaccurate information, and not to be discriminated against for exercising those rights. We do not sell personal information, do not “share” it for cross-context behavioral advertising, and do not disclose it to third parties for their own direct marketing. To make a request, contact clients@oceanus-cap.com; we will verify your identity before acting.
Children
This site is directed to institutional and accredited investors and other professional readers. It is not directed to children, and we do not knowingly collect personal information from anyone under 18.
Do Not Track and Global Privacy Control
Because the site does not track visitors across sites or sell or share personal information, browser “Do Not Track” and Global Privacy Control signals do not change how it behaves. We honor them to the extent applicable law requires.
